Terms

Last updated: 13 October 2026. These terms govern the use of the Bakım7/24 maintenance management software (cmms.bakim724.com and sub-domains assigned to accounts) and paid subscriptions; when accepted on the sign-up screen, a distance service contract is formed between the Service Provider and the business opening the account (the "Subscriber"). The accepted version is recorded on the account. This English version is provided for information; in case of conflict the Turkish text prevails.

1.1 Account. The person opening the account declares that they are authorised to represent the business. The Subscriber is responsible for the users it adds, the roles and permissions it grants, the accuracy of the data entered, and the confidentiality of passwords, two-factor codes and QR links. Where customer accounts are linked to a machine-manufacturer account, the manufacturer's visibility of customer records and management of customer users rests on the relationship between those parties, who bear the related consent and notice obligations.

1.2 Trial. New accounts start with a free 30-day trial with all modules enabled and no payment details. Reminders are sent to account administrators 7 and 3 days before the end. If no plan is paid for at the end of the trial the account is locked; data is not deleted and the account reopens once payment is confirmed.

1.3 Fees and payment. Plan fees and limits (users, storage, WhatsApp and AI quota, record counts) are shown on the subscription screen and in the quote; List prices are in US dollars (Factory $99/month, Manufacturer $199/month, Enterprise from $350/month; yearly billing equals 10 months) excluding VAT; payment is taken in Turkish lira at the Central Bank of Türkiye selling rate on the payment date, with a TRY invoice. Fees are paid in advance for each period by bank transfer; the Subscriber reports the payment with a receipt, and on confirmation the subscription is extended by one period and an invoice is issued. When card payment is enabled it is taken through the payment institution (PayTR); card details are not stored by Bakım7/24. When a quota is exceeded, new records or deliveries pause until the plan is upgraded or the period renews.

1.4 Non-payment. If payment for a new period is not confirmed when the current period ends, the account is locked: only sign-in, subscription, notifications and receipt upload remain available; data is not deleted. Commercial default interest may be charged on unpaid amounts under Turkish law. After 30 days of delay the Service Provider may terminate the contract by e-mail.

1.5 Term and termination. The subscription runs for the chosen period (monthly or yearly) and ends at the end of the period unless renewed. If the Subscriber terminates during a prepaid period at its own discretion, the remaining period is not refunded. If the Subscriber terminates for the Service Provider's material breach, or the Service Provider discontinues the service with 90 days' notice, the unused period is refunded pro rata. For serious breaches (attempting to access another account's data, circumventing security, overloading the service, unlawful content) the Service Provider may suspend the account and terminate the contract.

1.6 Right of withdrawal. The service is offered only to businesses acting for commercial or professional purposes, and the Subscriber declares that it subscribes for such purposes; consumer-protection withdrawal rules therefore do not apply. If the Subscriber is nevertheless deemed a consumer, a 14-day withdrawal right applies, except that it cannot be exercised for services performed instantly in electronic form once performance has begun with the Subscriber's consent.

1.7 Availability. The target is 99.5% monthly availability excluding planned maintenance. If availability in a calendar month falls below 99% for reasons attributable to the Service Provider, the Subscriber may, by written request within 30 days, receive a discount of 10% of that month's fee (25% below 95%) on the next period; this is the sole and exclusive remedy for downtime. Force majeure, the Subscriber's network/hardware faults and third-party outages are excluded. Planned maintenance is announced at least 24 hours in advance. When the connection drops, the app keeps entries on the device and sends them when it reconnects.

1.8 Support access. At the Subscriber's request or to resolve a fault, authorised staff of the Service Provider may enter the account in support mode for at most 120 minutes after recording a reason; every action is logged under the staff member's name and a red banner is shown in the account.

1.9 Third-party services. Integrations (ERP, SSO, WhatsApp, e-documents, etc.) rely on the Subscriber's own relationship with those parties; the Service Provider is not liable for their outages or terms. Regulatory templates in the app (periodic inspections, etc.) are aids only; compliance remains the Subscriber's responsibility.

1.10 Limitation of liability. To the extent permitted by law, the Service Provider's liability is limited to the subscription fees paid in the 12 months before the event giving rise to the claim; loss of profit, loss of production and indirect damages are excluded. Wilful misconduct and gross negligence are reserved.

1.11 Force majeure. Neither party is liable during natural disasters, epidemics, war, terrorism, strikes, general power or internet outages, cyber attacks or orders of authorities; if this lasts more than 30 days either party may terminate without compensation.

1.12 Intellectual property. The software, design and brand belong to the Service Provider; data entered by the Subscriber belongs to the Subscriber.

1.13 Changes, evidence, disputes. Material changes are notified at least 30 days in advance and do not apply to a prepaid period until it ends. The Service Provider's electronic records constitute evidence under Article 193 of the Turkish Code of Civil Procedure, without prejudice to counter-evidence. Turkish law applies; the courts and enforcement offices of İzmir (Central) have jurisdiction.

Personal data

Processing of personal data is described in the privacy agreement and notice; processing of Subscriber data in the data processing agreement in the app.
